This Contract aims to regulate the Terms and Conditions applicable to the activity booking service through the platform nattivus.com (hereinafter referred to as the "Platform").
Nattivus.com is an online platform dedicated to the publication and booking of tourist, cultural and leisure activities in Spain.
The ownership of the Platform belongs to Nattivus Experience S.L ("Nattivus"), an entity domiciled at Calle Teide nº 16, in Fresno de Torote, (C.P. 28815), Madrid, Spain, with Tax ID B-88014717. The contact email address is info@nattivus.com.
Although Nattivus offers tourist and leisure activities in general on its Platform, you declare that you understand that these activities are provided by third-party companies ("Collaborators"), selected taking into account strict reliability and quality criteria, and that Nattivus is limited to facilitating the publication, promotion and booking of these activities.
Accessing nattivus.com and booking the activities and/or services offered implies the acquisition of the status of user and the declaration that you have read, understood and accept these Booking Conditions, the Privacy Policy and the Terms of Use, which form an integral part of this Legal Notice.
To book the activities offered by Nattivus, you must follow the process established on the platform. Specifically, you must select the activity of your interest, the schedule, the number of participants, etc. and fill out the online booking form with the personal data requested. It is important that you review the information provided and correct any errors before making your booking effective, as once you click on the confirmation tab, you will not be able to modify your data.
By completing this form, you are indicating that you have read and understood the "activity description" and accept Nattivus' Terms and Conditions. We recommend that you pay special attention to the Cancellation Policy before making your booking.
In addition, you should keep in mind that activities may be subject to restrictions (age, weight, etc.) and it is your responsibility to comply with these requirements to make the booking.
Once your booking is paid, it will be processed by Nattivus.
Depending on the booked activity, you may receive confirmation immediately or within a maximum period of 24 hours. The type of confirmation applicable is indicated in the description of each activity.
Activities with immediate confirmation: Once the payment is completed, you will receive the confirmation and voucher for your booking by email.
Activities with confirmation within a maximum of 24 hours: Nattivus makes every effort to quickly update activity availability. However, Nattivus cannot guarantee the availability of all activities for all proposed dates. This is why some activities need to be verified with the collaborator who performs them before we can send you the confirmation.
In these cases, you will receive the confirmation by email within a maximum of 24 hours from the booking (the average time needed also depends on the diligent action of our collaborators). In the exceptional case that Nattivus could not confirm your booking, we will offer you alternative dates or other activities that might be of interest to you. If you are not satisfied with the options we offer you, you will have the possibility to cancel and receive a full refund of the amount you have paid. No compensation will be provided if the chosen activity is not available.
Once we confirm your booking, you will receive a personalized Nattivus voucher by email, which you must show to the corresponding collaborator at the time of the activity. Your booking will only be accepted upon presentation of a valid Nattivus voucher.
Nattivus offers 3 types of vouchers (we indicate which one you need in the "description" of each activity):
The name and contact information of the collaborator will be available on your booking voucher, as well as all the necessary details for your activity.
Nattivus will provide you with electronic copies of the corresponding vouchers for each booking made. Please note that each activity has an independent voucher.
It is your responsibility to keep the voucher and present it to the collaborator before starting the activity, along with a valid photo ID. The voucher may be invalidated if the above is not complied with.
The price of the activities offered by Nattivus includes VAT and any other tax that may be applicable at the rate in force at the time you make the booking.
The price includes everything detailed in the "Included" section in the description of each activity.
Prices do not include tips or drinks, food or anything else not specifically included in the "Includes" section of the activity description.
To book an activity through the Platform, you must pay the price indicated in the description of each activity at the time of making your booking.
If you have a Nattivus discount code, this discount will be applied when you enter your code in the corresponding field of your booking data form.
You can pay for your activity with credit or debit card and through PayPal. We accept the main bank cards in the world, both credit and debit (Visa, Visa Electron, Mastercard, American Express, etc.) and all cards accepted by PayPal.
No charge or commission will be applied for processing your booking payments by card.
Your payment data (for example, card number, expiration date, among others) will be processed securely using an SSL security protocol, being used only to carry out the procedure corresponding to your purchase or the issuance of refunds in case of cancellation.
Nattivus does not store your payment data or have access to it, only you and the entities that process the payment securely and reliably will have access to it.
In the event that you do not pay for the booked activity or revoke the payment, Nattivus will omit any possible claim for the benefits of the service.
If you make the payment for your booking in a currency other than the euro, your bank or card company may charge fees for converting your currency payment to euros, which will cause differences between the amount charged by Nattivus and the final amount that will be charged to your bank account or that will appear on your credit or debit card statement.
Nattivus guarantees you the best price available at the time of making your booking. However, if you find a lower price offer in the same currency as the original purchase, for the same dates, conditions and characteristics of the booked activity, we will match the price, refunding you the difference. This booking must be for a minimum of €20.
For this purpose, it will be necessary to present a complete and final budget (including all concepts of the booking: date, duration, participants, modality, management expenses, etc.), issued on the same day of the booking by another agency legally authorized to operate in Spain, from which any additional discount for belonging to a specific group will be excluded.
To request a refund, send a message to info@nattivus.com with your name and booking number, in addition to proof of the lower price (receipt, price list, brochure, web address, web screenshot, etc.). Refunds of the price difference will be processed to the credit card used for the original booking.
To request modifications or corrections to your booking, write to us at info@nattivus.com (specifying the booking number, your name and the date of the booked activity). We will attend to your request as soon as possible.
Please note that we cannot change or modify tickets for a special event, museum, theater or show. The sale of these tickets is final and cannot be modified once the original booking is confirmed.
All other requests for date changes or other modifications will be attended to, but are not guaranteed, pending the availability of our collaborators.
If you need to cancel a booked activity or request a refund, you must do so by sending an email to info@nattivus.com with the booking number, name and date of the activity.
The cancellation policy of an activity varies according to the terms of the collaborator who performs the activity. The information about the cancellation policy of each activity is detailed in the description of the activity itself and in your booking voucher.
However, in case it is not specified or there is any evident error in said cancellation policy, cancellations and refunds will be governed according to the following cancellation policy:
These conditions will also be applicable to cases of withdrawal or non-appearance. Likewise, Nattivus will not make any refund once the activity has started and it is abandoned for any reason.
The corresponding refund will be made between 24 and 48 hours from the cancellation of the activity in the same payment method with which you paid for the booking, which will be notified to you via email. Once the order is given, refunds made with debit/credit card may take 5 to 7 business days to appear reflected in your bank account and up to 30 days in the case of some foreign cards. Refunds made through PayPal will be effective in less than 24 hours.
Nattivus collaborators reserve the right to cancel a specific activity without adhering to the established cancellation period if weather conditions, government actions, unpredictable or unavoidable external circumstances endanger or make the exercise of the activity impossible or much more difficult.
In this case, the collaborator themselves, or failing that Nattivus, will notify you by email of such changes or cancellations and will propose either another date for the performance of the activity, or alternative activities that may be of interest to you.
In the event that it is not possible to set another date or this or other activities that we propose to you are not acceptable to you, you will be entitled to a refund of 100% of the booking amount, with any compensation for damages or other claims being excluded.
On occasions, our collaborators make changes to activities, such as dates, schedules, prices, inclusions, coverage, age requirements, etc. As a consequence, Nattivus on behalf of its collaborators, reserves the right to cancel, change or replace any detail of the activities at any time and for any reason.
Likewise, our collaborators reserve the right to make minor changes to the programs of the activities, if it is considered necessary due to unforeseen or unavoidable circumstances, without this altering the essence of them or committing us to make any refund or compensation.
As a user, you can give your opinion about the Activities you have enjoyed. For this purpose, you will be sent an evaluation email, 48 hours after the date of the activity.
Opinions will be published on the Platform under the name of the user who has performed the activity or anonymously in case you do not want the name to appear.
The collaborators (companies, agencies, tour guides, etc.) who provide the activities offered on this Platform are independent and are not agents or employees of Nattivus. Therefore, Nattivus is not responsible for the acts, errors, omissions, statements, warranties, breaches, negligence or misconduct of any of such collaborators, nor for any personal injuries, death, property damage or other damages or expenses that arise from this or that arise in any other way from the booking or use by you of an activity or service.
Nattivus will also not be responsible for any type of delay, itinerary change or cancellation of an activity by a collaborator.
You agree that the applicable law for the operation of these conditions is Spanish law.
The Courts and Tribunals of the city of Madrid will be competent to resolve any disputes that arise from the interpretation or application of this contract.
